माननीय पटना उच्च न्यायालय प्रशासन ने रजिस्ट्रार जेनरल श्री रूपेश देव को भागलपुर का नया जिला एवं सत्र न्यायाधीश यानी जिला जज के रूप में नियुक्त किया है। इस आशय की अधिसूचना हाईकोर्ट प्रशासन ने 22 दिसंबर 2022 को जारी की है। भागलपुर के नए जिला जज खगड़िया के रहने वाले हैं। भागलपुर के वर्तमान जिला जज श्री शिवगोपाल मिश्रा का तबादला मधेपुरा के जिला जज के रूप में किया गया है। इसके अलावा भी कई न्यायाधीशों की ट्रांसफर पोस्टिंग की गई है। वहीं एडीजे तृतीय भागलपुर सह स्पेशल जज एससीएसटी कोर्ट श्री रोहित शंकर का तबादला पूर्णिया न्यायालय किया गया है। वहीं एक दर्जन से अधिक न्यायाधीशों का भी तबादला किया गया है। बताया जाता है कि जल्द ही पूरे बिहार में काफी संख्या में प्रथम श्रेणी न्यायिक दंडाधिकारी व अपर मुख्य दंडाधिकारी का भी तबादला होगा। एक ही स्थान पर तीन साल का टर्म पूरा कर चुके न्यायाधीशों की सूची को अंतिम रूप दिया जा रहा है।

He died during treatment at a private hospital in the city at around 12:30 pm on Thursday. The members of the Bhagalpur District Advocates Association became mournful after receiving the information of his death. Since Friday morning, a large number of Bhagalpur lawyers reached his residence near the Bari post office and had his last darshan. Later his body was brought from his residence to the DBA campus where a large number of lawyers paid floral tributes to him by garlanding him. He left behind the world, leaving behind a son Amit Kumar, his wife. Junior advocate Vishal Kumar, who was an aide of senior advocate, told that he is saddened to lose his senior and mentor lawyer. He said that he used to help his junior lawyers a lot in the advocacy profession. भागलपुर के वरिष्ठ अधिवक्ता अरुण कुमार झा का निधन हो गया है। वे करीब 70 वर्ष की उम्र के थे । गुरुवार देर रात करीब 12:30 बजे उनका निधन इलाज के दौरान शहर के एक निजी अस्पताल में हो गया। उनके निधन की सूचना पाकर भागलपुर जिला अधिवक्ता संघ के सदस्यगण शोकाकुल हो उठे। शुक्रवार की सुबह से ही बड़ी संख्या में भागलपुर के वकील उनके बड़ी डाकघर के समीप स्थित आवास पर पहुंचे तथा उनका अंतिम दर्शन किया। बाद में उनके शव को उनके आवास से डीबीए परिसर लाया गया जहां बड़ी संख्या में वकीलों ने पुष्प माला चढ़ाकर उन्हें भावभीनी श्रद्धांजलि दी। वे अपने पीछे पत्नी समते एक पुत्र अमित कुमार को छोड़कर दुनिया से विदा हो गए। वरिष्ठ अधिवक्ता के सहयोगी रहे जूनियर अधिवक्ता विशाल कुमार ने बताया कि वे अपने सीनियर व गुरु वकील को खोकर शोकाकुल हैं। उन्होंने कहा कि वकालत के पेशे में वे अपने जूनियर वकीलों की भरपूर मदद करते थे। उनके निधन पर डीबीए के महासचिव अंजनि कुमार दूबे, अध्यक्ष मनोज कुमार सहाय, वरिष्ठ अधिवक्ता अभयकांत झा, किशोर कुमार झा, समेत डीबीए एडहॉक कमेटी के कई सदस्यों ने दिवंगत अधिवक्ता के आवास पर पहुंचकर उन्हें नमन किया। उनके निधन पर सरकारी वकील ओमप्रकाश तिवारी ,जयकरण गुप्ता, भोला कुमार मंडल ,जयप्रकाश यादव व्यास, वीरेश प्रसाद मिश्रा, प्रफुल्ल चंद्र राही समेत अन्य वकीलों ने गहरा दुख जताते हुए इसे भागलपुर न्याय जगत को बड़ी क्षति बताया। उनके निधन के कारण शुक्रवार को डीबीए के जारी पत्र के बाद अधिवक्ताओं ने उनके सम्मान में खुद को अदालत के कामकाज से अलग रखा। वकीलों ने बताया कि स्व. झा करीब 35 साल से अधिक समय से भागलपुर सिविल कोर्ट में क्रिमिनल लॉयर के रूप में अपनी सेवा दे रहे थे।

लीगल न्यूज, भागलपुर। सालों साल का झंझट मिनटों में सुलझ सकता है। बस आप एक बार लोक अदालत तो आएं। लोक अदालत में पक्षकारों का स्वागत है। इसी संदेश के साथ जिला विधिक सेवा प्राधिकार भागलपुर के द्वारा इसी वर्ष साल के अंतिम लोक अदालत का आयोजन 11 दिसंबर को किया जा रहा है। राष्ट्रीय लोक अदालत की कामयाबी के लिए सोमवार को जिला जज सह जिला विधिक सेवा प्राधिकार के अध्यक्ष शिव गोपाल मिश्रा की अध्यक्षता में उनके कार्यालय में विभिन्न बैंकों के अधिकारियों की बैठक हुई। जिसमें जिला जज ने बैंक अधिकारियों से कहा कि राष्ट्रीय लोक अदालत में अधिक से अधिक वादों के निष्पादन के लिए वे लोग पक्षकारों को नोटिस करें । उन्होंने पक्षकारों को नोटिस जारी करने का निर्देश दिया । साथ ही उन्होंने पोक्सो अधिनियम के तहत एक पीड़िता की मां को ₹50,000 का अंतरिम मुआवजा भी दिया मौके पर जिला विधिक सेवा प्राधिकार के सचिव एडिशनल सेशन जज अतुल वीर सिंह एवं अन्य न्यायिकअधिकारी मौजूद थे । राष्ट्रीय लोक अदालत की सफलता के लिए जिला विधिक सेवा प्राधिकार की ओर से पक्षकारों को आमंत्रित किया जा रहा है तथा उनसे कहा जा रहा है कि सेटलमेंट के जरिए अपने पुराने मामलों का को सुलझा लें। संदेश दिया जा रहा है लोक अदालत में न कोई जीतता है ना कोई पक्ष हारता है बल्कि दोनों ही पक्ष जीतता है। वर्षों का मुकदमा मिनटों में मौके पर सुलझ जाता है और सब कुछ अच्छा हो जाता है। वहीं आजादी के अमृत महोत्सव के अवसर पर मनाया जा रहे कार्यक्रम की कड़ी में एक नवंबर को जिला विधिक सेवा भागलपुर की ओर से जागरूकता कार्यक्रम का आयोजन जिला स्कूल भागलपुर में किया गया जिसमें भारतीय कानून की जानकारी एवं अधिकारों के महत्व को बताया गया। मौके पर न्यायिक अधिकारी राहुल दत्ता, पैनल अधिवक्ता रामस्वरूप सिंह, अवधेश कुमार सिन्हा, पीएलवी प्रशांत राय आदि ने छात्रों को लोक अदालत के जरिए मुकदमों के निष्पादन का स्वरूप बताया। अमृत महोत्सव के तहत डोर टू डोर जाकर कानून की जानकारी आम लोगों को दी जा रही है।

Senior Lawyer of Naugachia Bar Association Yogendra Prasad Yadav (75) passed away. He breathed his last on Sunday night at his residence in Professor Colony. As soon as the news of his death was received, the people of the city started reaching his residence for the last glimpse. According to the information received from the family members, they were going to rest after having dinner. Then there was a heart attack and he died instantly. He served for a long time in the Naugachia Civil Court.
बार एसोसिएशन नवगछिया के वरिष्ठ सदस्य सह नवगछिया न्यायालय के वरिष्ठ अधिवक्ता व समाजसेवी योगेंद्र प्रसाद यादव (75) का निधन हो गया है। रविवार की रात प्रोफेसर कॉलोनी स्थित अपने आवास पर उन्होंने अंतिम सांसें ली है। उनके निधन की खबर मिलते ही शहर के लोग उनके आवास पर अंतिम दर्शन के लिए पहुंचने लगे। परिवार वालों से मिली जानकारी के अनुसार रात का खाना खाने के बाद वे आराम करने जा रहे थे। तभी हार्ट अटैक हो गया और उनकी तत्काल मौत हो गयी। नवगछिया व्यवहार न्यायालय में वे लोकप्रिय वकील के रूप में जाने जाते थे।

आधुनिक एवं वैज्ञानिक युग में वैज्ञानिक आविष्कारों ने युद्ध को विनाशकारी बना दिया है। इसी तरह घरेलू झगड़ों ने भी समाज को आज तोड़ कर रख दिया है। संयुक्त राष्ट्र चार्टर के अनुच्छेद 33 में अंतरराष्ट्रीय विवादों के शांतिपूर्ण समाधान की प्रक्रिया का उल्लेख किया गया है। अंतरराष्ट्रीय विवादों को निपटाने के सुझाए गए शांतिपूर्ण तरीके आज समाज में भी घरेलू एवं पारिवारिक झगड़ों को निपटाने का सबसे कारगर तरीका है।
इन तरीकों में –
पहला वार्ता या बातचीत या न्यूगोसियेसन NEGOTIATION – राष्ट्रों के बीच में झगड़े हो या परिवार के बीच झगड़े समाप्त करने का यह बहुत ही सरल लेकिन महत्वपूर्ण तरीका है बातचीत या वार्ता के द्वारा संदेह एवं भ्रांतियों को दूर कर नीतियों को स्पष्ट किया जा सकता है। जिससे मतभेद दूर किया जा सके। इस प्रकार की वार्ता राज्यों के अध्यक्ष के बीच तथा उनके प्रतिनिधियों के बीच या फिर उनके राजदूतों के बीच होती है। इस तरह घर या परिवार में घर के मुखिया या घर के वरिष्ठ तथा परिवार के अन्य लोगों के बीच बातचीत हो सकती है।
सुलह या कॉन्सिलिएशन CONCILIATION – सुलह का तात्पर्य पक्षकारों के बीच समझौता करना होता है। इसके अंतर्गत निष्पक्ष राज्य या निष्पक्ष व्यक्तियों के आयोग को मामला सौंप दिया जाता है। राज्य या आयोग अपनी रिपोर्ट में समस्या के निवारण के लिए सुलह के लिए प्रस्ताव देते हैं। यह प्रस्ताव पक्षकारों के लिए बाध्यकारी नहीं होते हैं, फिर भी विवादों को निपटाने का यह भी एक सरल व कारगर तरीका है। इंटरनेशनल विवाद की तरह ही घरेलू या पारिवारिक विवाद में भी इसका उपयोग किया जा सकता है। ये हो भी रहा है। जो कारगर है।
पंच निर्णय या आर्बिट्रेशन ARBITRATION – पंचों द्वारा झगड़े को समाप्त करने का तरीका प्राचीन समय से ही चला रहा है। इसके अंतर्गत पक्षकार अपनी इच्छा अनुसार विवाद के निपटारे के लिए पंचों को चुनते हैं। पंच निर्णय के लिए यह आवश्यक है कि निर्णय से ऐसे सिद्धांतों पर आधारित हो जो पहले से प्रचलित और उसने मान्यता का रूप ले लिया है। पंच का निर्णय अगर किसी पूर्व सिद्धांत पर आधारित न होकर अपनी इच्छा के अनुसार देते हैं तो निर्णय एकपक्षीय या एक्सपार्टी होगा और उसे मान्यता नहीं दी जा सकती है। इसलिए कहा गया है पंच परमेश्वर।
सेवाएं या गुड ऑफिसेज GOOD OFFICES- जब दो राष्ट्र अपने झगड़े का निपटारा आपस में नहीं कर पाते हैं तो तीसरा मित्र राष्ट्र उनके झगड़े को निपटाने में सहायता कर सकता है। इसमें तीसरा राष्ट्र विवाद को निपटाने में अपनी सेवाएं अर्पित करता है परंतु वह स्वयं इसमें भाग नहीं लेता है। यही समाज में होता है जब दो परिवार या दो व्यक्ति आपस में लड़ते हैं तीसरा व्यक्ति भले उसमें शामिल हों लेकिन वह अपनी सेवाएं झगड़े को सुलझाने में देकर तटस्थ रहकर विवाद का हल ढूंढ सकता है।
मध्यस्थता या मेडिएशन MEDIATION- मध्यस्थता के द्वारा भी तीसरा राष्ट्र अपने प्रयासों के द्वारा झगड़े को निपटाने का प्रयास कर सकता है। इस प्रयास में मध्यस्थता करने वाला राष्ट्र अपनी सेवाएं अर्पित नहीं करता बल्कि वार्ता में भी सम्मिलित रहता है। घरेलू झगड़ों एवं पारिवारिक विवाद को इसके जरिए भी दूर कर अदालतों में मुकदमों का बोझ कम किया जा सकता है।
अंतरराष्ट्रीय जांच आयोग OR इंटरनेशनल कमिशन ऑफ इंक्वायरी INTERNATIONAL COMMISSION OF ENQUIRY-
अंतरराष्ट्रीय आयोग विवादों की जांच के लिए गठित किया जाता है। यह आयोग विवादों के आधार का अध्ययन करता है। तथा विवादों के समाधान के लिए सुझाव प्रस्तुत करता है। इन सुझावों द्वारा ही जांच आयोग शांतिपूर्ण ढंग से अंतरराष्ट्रीय विवादों को निपटाने के लिए मार्ग निश्चित करता है।
जांच या इंक्वायरी INQUIRY – विवादों के निपटाने का यह एक महत्वपूर्ण तरीका है। इसके अंतर्गत तथ्यों की खोज की जाती है। इसका मुख्य उद्देश्य झगड़े से संबंधित तथ्यों की जांच करके उन्हें स्थापित करना है जिससे झगड़े का निपटारा हो सके। इस प्रकार उपरोक्त वर्णित शांतिपूर्ण तरीके से अंतर्राष्ट्रीय विवाद को सुलझाने के दो तरीके हैं। एक्स्ट्रा ज्यूडिशियल सेटलमेंट EXTRA JUDICIAL SETTLEMENT – एक्स्ट्रा ज्यूडिशियल सेटलमेंट के अंतर्गत विवादित राज्य अपने विवादों को करार के माध्यम से समझाते हैं। इसे राजनयिक प्रक्रिया भी कहा जाता है। वार्ता, सुलह, सेवाएं,मध्यस्थता के द्वारा किया गया निपटारा इसके अंतर्गत आते हैं।
ज्यूडिशियल सेटलमेंट JUDICIAL SETTLEMENT – ज्यूडिशियल सेटलमेंट विवादों को सुलझाने की एक विधिक प्रक्रिया है। दो राज्यों के बीच विवादों को सुलझाने में तीसरा राज्य मध्यस्थता करता है। तीसरा राज्य विधि एवं तथ्यों के आधार पर विवादों का निपटारा करता है। पंच निर्णय, अंतरराष्ट्रीय न्यायालय, अंतरराष्ट्रीय जांच आयोग के द्वारा किया गया निपटारा इसी प्रक्रिया के अंतर्गत आते हैं।

More than 2,000 cases were disposed in the National Lok Adalat held at Bhagalpur Civil Court on Saturday under the leadership of Rumpa Kumari, a woman judge and secretary of Dalsa, and under the guidance of district judge Sri Shivgopal Mishra. 15 Benches were constituted for the execution of cases in Lok Adalat organized under the banner of Dalsa. All the cases were disposed on the spot. In which 50 cases were related to claim cases. The Lok Adalat was jointly inaugurated by District Judge Shiv Gopal Mishra, Principal Judge of Family Court Hemant Kumar Tripathi, DM Subrata Kumar Sen, Dr Hemshankar Sharma, City SP Swaran Prabhat and Dalsa Secretary Rumpa Kumari. Raman Karan conducted the function. Lok Adalat was successfully organized in Bhagalpur under the leadership of Dalsa Secretary Rumpa Kumari. It was told that while settling the 2006 case on the spot, a settlement of 12 crores was also done.

Rukhsana of Ludhiana and Mohd of Lodipur. The Lok Adalat held on Saturday proved lucky for Qamar. In the trial that took place after 8 months of marriage, after 3 years, the decision came with the consent of both the parties. The family court persuaded both of them to agree to live together and the husband and wife happily went home. In the factory of Rukhsana’s father, Mohd. Kamar used to work. Ishq Parwan Chadha and both of them got married on 7 March 2018 with family consent. Rukhsana left Ludhiana and started living with her in-laws’ house in Lodipur. During this, there was a dispute with the mother-in-law and she went to her maternal home. Qamar admired, but Rukhsana did not return. Then Mo. Qamar filed a case in the family court on 25 October 2018 after 8 months of marriage. After about 3 years, on the initiative of the court, both were reunited again.
38 cases of family court were listed, 6 settled, settlement of 7.21 crore in 1289 bank cases Bibi Sahida of Radhanagar filed a maintenance case against her husband Imtiaz, a resident of Puraini. Both agreed to live together in court. In this way 6 cases were settled. Although 38 cases were listed. Dalsa secretary Rumpa Kumari said that 2006 cases were disposed of in all the benches in Bhagalpur. In this, 50 cases were related to claim cases. In the motor accident insurance suit, a claim of 4.77 crore was given to the dependents of the deceased. Reconciliable 465 criminal cases were also settled and an amount of 3.29 lakhs was settled. 78 cases related to electricity were settled and an amount of 33.99 lakhs was settled. 2.47 lakh in 89 cases of BSNL, 25 thousand in 9 cases of labor dispute, 7.21 crore in 1289 cases related to bank loan, 17 lakh in 14 cases of NI Act.
